Welcome to CyberNet Labs. These Terms & Conditions (“Agreement”) govern your access to and use of all services provided by CyberNet Labs (“we,” “us,” “our”), including but not limited to:
CyberGuard penetration testing services
AI Chatbot Security Assist
Custom AI cybersecurity automation solutions
Use of our website cybernetlabs.co.za
Purchase of services using Paystack payment processing
By accessing our services, signing up for an account, or making a purchase, you agree to be bound by this Agreement.
Client / Customer: The business, entity, or individual using our services.
Services: All cybersecurity related services provided, including penetration testing, AI-enabled services, support, consulting, and custom development.
Agreement: These Terms & Conditions and any Order Form or Quote you agree to.
You affirm that:
You are a business entity or authorized representative of a business.
You have the legal authority to enter into this Agreement.
You will use the services only for lawful purposes.
If you do not agree to these terms, do not use our services.
CyberGuard services are designed to identify vulnerabilities in your systems.
We will conduct tests based on the scope agreed in writing.
You agree to obtain all necessary permissions for systems you request us to test.
We provide AI-driven chatbot solutions designed to assist with security workflows. You acknowledge:
AI responses are based on best-effort prediction models.
No guarantees are made regarding the accuracy of automated output.
Custom services are scoped and delivered per agreement. You must provide accurate access and information.
You agree to:
Provide accurate and complete information.
Maintain backups of all systems and data before any testing activity.
Ensure your systems and personnel comply with applicable laws.
Notify us promptly of any issues that could conflict with the testing schedule.
All fees are set out in the applicable Quote or Order Form. Payments must be made via Paystack, and you authorize Paystack to process payments on our behalf.
You are responsible for all taxes due on the services purchased.
We may suspend or terminate services for nonpayment.
Refunds are only available in accordance with our separate Refund & Cancellation Policy, which you must review before purchase.
We retain all rights, title, and interest in:
Our reports, code, models, interfaces, documentation, and tools.
Any IP developed outside your specific deliverables.
You retain rights to your data and any outputs we generate for you, subject to usage rights granted in this Agreement.
We will treat your confidential information with reasonable care.
You agree not to disclose our proprietary methodologies or results except as required under law.
You must comply with your own data protection obligations under applicable law.

To the maximum permitted by law:
Our total liability for any claim arising from this Agreement shall not exceed the amount the Client paid us for the specific service giving rise to the claim.
We are not liable for indirect, punitive, incidental, special, or consequential damages, including lost profits or data loss.
We do not guarantee that our services will be error-free, completely secure, or free from bugs.
This clause survives termination of this Agreement.
You agree to defend, indemnify, and hold us harmless against any third-party claims arising from:
Your use of the services outside the intended scope.
Your failure to comply with laws.
Unauthorized use of your systems.
This Agreement is governed by the laws of the Republic of South Africa.
Any unresolved dispute will be resolved through arbitration before a commercial arbitrator in South Africa.
We may update these Terms at any time. We will post changes on our website and you will be bound by continued use of our services.
